OCTAPULL cares about the privacy and protection of information provided by users while using the services offered through the website accessible at www.octapull.com ("Website") and the OCTAPULL application for iOS-based mobile devices and the OCTAPULL application for Android-based mobile devices ("Mobile Applications"). Therefore, it explains how the information obtained will be used and protected, subject to the conditions specified in this "Privacy Policy". By visiting the Website, downloading the Mobile Applications, or requesting to use the services, users accept the conditions specified in this "Privacy Policy".

Article 1 – PROTECTION AND USE OF INFORMATION

OCTAPULL uses next-generation technologies to protect users' information in a secure environment. Information provided by users cannot be viewed by other internet users. In corporate purchases, people within the same organization (hierarchically) can view the information. In individual use, no one from outside can access the information unless the user shares it. User and member information is kept confidential by OCTAPULL regarding the protection of trade secrets and necessary measures are taken. OCTAPULL stores and protects the information provided by users in a cloud environment for business continuity, currency, and transaction security. However, information may be disclosed within the framework of public information and requests from authorized authorities or legal requirements. If institutions prefer to store data on their own servers, they accept their responsibilities regarding server security, which differs from the privacy policy.

ARTICLE 2 – INFORMATION SOURCES

Information about users is obtained from three different sources:

2.1. Information provided by users through the Website or other communication channels is received and recorded. This information is completely provided by the user's free will. For service delivery and accuracy, it is recommended that all requested information be provided. Missing or incorrect provision of required mandatory information may result in the service request not being fulfilled.

ARTICLE 3 – OTHER TERMS OF USE

OCTAPULL may send commercial electronic messages within the scope of Law No. 6563 on the Regulation of Electronic Commerce and related regulations. Distance Sales Agreement

Article 1 – PARTIES

1.1 This Membership and Usage Agreement ("Agreement") has been made between OCTAPULL (hereinafter referred to as "SERVICE PROVIDER") and OCTAPULL Users (hereinafter referred to as "USER") on the other hand. The term SUB-USER in this agreement refers to the persons for whom the USER is responsible for the actions of the USER who uses OCTAPULL with the username and password given to them, within the framework of the number of users and authorities of the OCTAPULL license defined to the USER.

1.2 The documents named "Terms and Conditions of Use" and "Our Privacy Policy" on the Website defined below constitute the inseparable annexes of this Agreement. The USER declares, accepts, and undertakes that a copy of the documents named "Terms and Conditions of Use" and "Our Privacy Policy" was given to them by the SERVICE PROVIDER before the signing of the Agreement, that they accept the provisions in these documents as they are, that these provisions are also part of this Agreement and binding on the USER and SUB-USER, and that they will comply with these provisions as with the provisions of this Agreement.

Article 2 – PURPOSE

This Agreement has been prepared to determine the conditions and terms regarding the use of OCTAPULL, which can be accessed from internet-connected computers and mobile devices via web version or IOS/android-based mobile applications created by the SERVICE PROVIDER, by as many people as the number of users defined to the user, and the information, documents, and data uploaded to OCTAPULL, and the rights and obligations of the parties.

OCTAPULL is a cloud-based SaaS (Software as a Service) application that, with the modules it contains, enables video conference calls, brings users and their customers together on an online platform, enables field activities to be planned, tracked, and carried out in an online environment, and allows people to record information belonging to themselves and/or third parties with their own usernames and passwords.

OCTAPULL is a cloud platform that eliminates additional hardware, middleware, installation, and application costs, unforeseen application and update costs, converts capital expenditures into operating expenses, manages software and audits cloud security, reduces data loss risk, optimizes business processes, reduces expensive and time-consuming data analysis costs, enables real-time access to data and saves time, and mobilizes the workforce.

The SERVICE PROVIDER always reserves the right to make changes to the platform content, release new versions and expanded forms, add new features to OCTAPULL, or remove existing features to develop the online platform subject to the contract.

Article 3 – WEBSITE AND MOBILE APPLICATION

3.1 The Website that the USER will benefit from within the scope of this Agreement is the website at www.octapull.com created and operated by the SERVICE PROVIDER. The mobile application is the application named OCTAPULL on IOS-based mobile devices and the applications named OCTAPULL on Android-based mobile devices created and operated by the SERVICE PROVIDER.

3.2 Content service and platform service are basically provided to USERS on the Website and mobile applications. OCTAPULL; -except for matters to be added by the SERVICE PROVIDER in the future- consists of modules such as video conferencing, planning, implementation, reporting, etc., and is a platform/service that enables people who log into the platform according to the USER and/or the number of users purchased by the USER to come together with their customers on the online platform and carry out field activities such as online meetings, webinars, and meeting analysis, and helps optimize business processes in such a way that the control and accessibility of the storage area defined to them belongs entirely to themselves and/or the users they define. The purpose of OCTAPULL is to provide content service and to facilitate trade between businesses and sellers/providers and their customers by creating an electronic market/working environment through the E-Platform.

3.3 The SERVICE PROVIDER is solely authorized to determine how the Website and Mobile applications will be used by users, how users/sub-users will communicate with each other, what kind of transactions can be made, how these transactions will be made, what functions the platform will perform, the scope and nature of the content, to set minimum and/or maximum limits on transactions to be made through the platform, to cancel and change these at any time and in any way it wishes, and to take all measures it deems necessary for the operation of the website and/or mobile applications. The USER has accepted this authority of the SERVICE PROVIDER and has committed to act accordingly.
